TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the CoinMarketMan and HyperTracker platforms, products, services, websites, applications, dashboards, APIs, alerts, and related tools (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.


1. Company Details

The Services are operated by: C M M Software Co LLC Dubai, United Arab Emirates ("CMM", "we", "us", "our")

CoinMarketMan and HyperTracker are brands operated by the same legal entity under a single account system and domain.


2. Scope of These Terms

These Terms apply to all users of the Services, including users of:

  • CoinMarketMan analytics and dashboards
  • HyperTracker analytics and dashboards
  • HyperTracker alerts and notifications
  • HyperTracker API (including REST, WebSocket, and Webhooks)
  • Free plans, paid subscriptions, and enterprise or custom plans

Certain Services are governed by Product-Specific Schedules attached to these Terms:

  • Schedule A: CoinMarketMan (CMM)
  • Schedule B: HyperTracker Alerts
  • Schedule C: HyperTracker API

If there is any conflict between these Terms and a Schedule, the Schedule will prevail for that product.


3. Eligibility & Accounts

You must create an account to access certain Services.

You are responsible for:

  • All activity under your account
  • Keeping credentials secure
  • Ensuring all information you provide is accurate

We may suspend or terminate accounts at any time in accordance with these Terms.


4. Nature of the Services (No Advice)

The Services provide data, analytics, alerts, and informational tools only.

We do not:

  • Provide investment advice
  • Provide trading recommendations
  • Act as a broker, exchange, or financial advisor
  • Guarantee outcomes, profits, or performance

All trading decisions are made solely by you, at your own risk.


5. Payments, Billing & Subscriptions

5.1 Payment Methods

We may accept payments via:

  • Credit/debit card (e.g. Stripe)
  • Cryptocurrency payments (via CoinPayments or similar providers)

Available payment methods may vary by product and plan.

5.2 Subscription Types

Depending on the Service, subscriptions may be:

  • Monthly or annual (credit card)
  • Annual, one-time payments (cryptocurrency)

Cryptocurrency payments:

  • Do not auto-renew
  • Expire at the end of the paid term
  • Must be manually renewed

5.3 Renewals

Credit card subscriptions renew automatically unless cancelled before renewal.

5.4 No Automatic Refunds

All purchases are access-based.

  • No automatic refunds are provided once access is granted
  • Any refunds are issued solely at our discretion as a goodwill gesture
  • If a refund is issued, access will be revoked immediately
  • Chargebacks may result in immediate account suspension or termination.

6. Usage Limits & Plan Changes

Usage limits, features, and entitlements:

  • Are determined by the plan you purchase
  • May change over time
  • Are described on our pricing pages or dashboards, not in these Terms

We reserve the right to modify plans, limits, or features at any time.


7. Acceptable Use

You must not:

  • Abuse, overload, or interfere with the Services
  • Circumvent technical limitations or safeguards
  • Scrape, reverse engineer, or misuse the Services
  • Use the Services for unlawful purposes

We may suspend or terminate access without notice for abuse or misuse.


8. Data, Analytics & Intellectual Property (Revised)

8.1 Data Sources

The Services process data from multiple sources, including:

  • Public, on-chain blockchain data
  • User-authorised read-only API data from third-party cryptocurrency exchanges
  • Service usage data generated through interaction with the platform

Users explicitly authorise access to exchange data by providing read-only API keys. We do not request, support, or permit trading, withdrawal, or account-modifying permissions.

8.2 User Exchange Data (CMM)

With respect to read-only exchange API data:

  • You retain ownership of your raw account and trade data
  • We access such data solely to provide the Services
  • We do not sell individual user data, account-level insights, or personal trading information
  • We do not share identifiable account data with third parties We implement technical and organisational safeguards to protect user data, as described on our Security page: https://coinmarketman.com/security/

8.3 Aggregated & Anonymised Data

You acknowledge and agree that CMM may:

  • Aggregate data across multiple users
  • Anonymise such data so it cannot be linked to any individual or account
  • Use aggregated datasets to generate platform-wide analytics, benchmarks, and intelligence

Examples include (without limitation):

  • Market-wide positioning statistics
  • Cohort-level behavioural insights
  • Aggregated performance metrics

No aggregated outputs identify individual users, accounts, or exchanges.

8.4 Aggregated & Derived Data Ownership

CMM owns all rights, title, and interest in:

  • Aggregated datasets
  • Derived analytics
  • Benchmarks
  • Models
  • Intelligence outputs
  • Visualisations and metrics generated by the Services

This ownership applies regardless of whether aggregated outputs are derived from:

  • Public blockchain data
  • User-authorised exchange data
  • Platform-generated analytics

8.5 Use of Aggregated Data

We may use aggregated and derived data to:

  • Power products and features
  • Produce intelligence and analytics
  • Create benchmarks
  • Offer insights to users and partners

Such use does not expose or disclose individual user data.

8.6 Licence to Use the Services

You are granted a limited, non-exclusive, non-transferable licence to access and use the Services for their intended purpose.

No rights are granted to:

  • Copy
  • Resell
  • Redistribute
  • Repackage

any proprietary outputs, analytics, or datasets unless expressly permitted in writing.

Much of the data used by the Services is derived from public, on-chain blockchain data.

You acknowledge that:

  • Public blockchain data is not owned by you
  • We do not guarantee completeness or accuracy of raw data

9. Attribution

Where permitted, public use of outputs may require attribution such as:

"Powered by HyperTracker"

Specific attribution requirements are detailed in Schedule C.


10. Suspension & Termination

We may suspend or terminate your access at any time, with or without notice, including for:

  • Abuse or misuse
  • Excessive load or API abuse
  • Non-payment
  • Legal or regulatory reasons

Upon termination:

  • Access ends immediately
  • No refunds are owed

11. Availability & Downtime

The Services depend on third-party infrastructure, blockchain networks, and external providers.

We do not guarantee:

  • Uptime
  • Availability
  • Timeliness of data
  • Continuous operation

12. Limitation of Liability

To the maximum extent permitted by law:

  • The Services are provided "as is" and "as available"
  • We disclaim all warranties, express or implied
  • We are not liable for indirect, incidental, or consequential losses Our total liability is capped at the fees you paid to us in the twelve (12) months preceding the claim.

13. Indemnity

You agree to indemnify and hold harmless CMM from any claims arising from:

  • Your use of the Services
  • Your breach of these Terms
  • Your misuse of data or outputs

14. Governing Law

These Terms are governed by the laws of the United Arab Emirates.

Courts of the UAE shall have exclusive jurisdiction.


15. Changes to These Terms

We may update these Terms at any time by posting an updated version.

Continued use of the Services constitutes acceptance of the updated Terms.

SCHEDULE A — COINMARKETMAN (CMM)

This Schedule applies to CMM analytics and dashboards.

  • Provides trade aggregation, analytics, and portfolio insights
  • Requires exchange connections or imports
  • Usage, refresh rates, and features depend on plan
  • Access is time-based (monthly or annual)
  • No trading advice is provided.


SCHEDULE B — HYPERTRACKER ALERTS

This Schedule applies to HyperTracker alerts and notifications.

  • Alerts are informational only
  • Alerts may reference wallet activity or behaviour
  • Alerts are not trading signals
  • Delivery depends on third-party services (e.g. Telegram)

We do not guarantee:

  • Delivery
  • Timeliness
  • Accuracy
  • Completeness

You are solely responsible for how you use alert information.



SCHEDULE C — HYPERTRACKER API

This Schedule applies to all API access.

API Usage

  • Subject to plan-based limits and rate controls
  • Limits may reset periodically
  • Limits and rates may change

Commercial Use

  • Commercial use is permitted
  • Redistribution or resale requires a custom agreement
  • Attribution required: "Powered by HyperTracker"

Enforcement

We may throttle, suspend, or terminate API access at our discretion for abuse or misuse.

No SLA

No service-level guarantees are provided unless separately agreed in writing.
